This Privacy Policy explains how Acoustas LLC (“Acoustas,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information when you visit acoustas.com (the “Site”), purchase our products, or use the AirDSP application and related software (together, the “Services”). Acoustas LLC is the controller responsible for your personal information.

By using the Site or Services, you agree to the practices described in this Policy.

1. Information We Collect

Information you provide to us:

  • Account and contact details: name, email address, and phone number.
  • Order information: billing and shipping address, and the products you purchase.
  • Payment information: processed by our payment providers. We do not store full card numbers on our own systems.
  • Account and cloud content: if you create an Acoustas account and use our cloud features, the content you save, such as presets, channel names, device and system configurations, saved models, and related metadata.
  • Support and communications: messages you send us, and product reviews or feedback you submit.
  • Marketing preferences: your choice to subscribe to our newsletter or promotional emails.

Information collected automatically:

  • Device and usage data: IP address, browser type, operating system, pages viewed, and interactions with the Site.
  • Application data: when you use the AirDSP app, we may collect device and diagnostic information such as app version, operating system, device model, connection status, feature usage, and crash reports, to keep the app working reliably.
  • Cookies and similar technologies: used to operate the Site, remember your preferences, and understand how the Site is used. See Section 5.

2. How We Use Your Information

  • To process and fulfill your orders and provide customer support.
  • To operate, maintain, and improve the Site, products, and Services.
  • To store, back up, and sync your account content across your devices when you use our cloud features.
  • To develop new products and features and to diagnose and fix technical problems.
  • To personalize your experience and remember your preferences.
  • To send you service messages (such as order confirmations and important updates).
  • To send marketing communications where you have opted in, and which you can opt out of at any time.
  • To detect, prevent, and address fraud, security issues, and misuse.
  • To comply with our legal obligations and enforce our terms.

3. How We Share Your Information

We do not sell your personal information. We share it only as needed to run our business:

  • Service providers: including our ecommerce platform (Shopify), payment processors, shipping carriers, email and marketing providers, review platforms, cloud hosting and storage providers, and analytics and crash-reporting providers, who process data on our behalf.
  • Legal and safety: when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Acoustas, our customers, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
  • With your consent: in any other case where you direct us to share your information.

4. Payments

Payments are handled by our payment providers through Shopify's checkout. Your card details are transmitted directly to the payment processor and handled under their security standards. We receive confirmation and limited transaction details needed to fulfill and account for your order.

5. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, keep your cart and preferences, measure performance, and understand usage. You can control cookies through your browser settings; disabling some cookies may affect how the Site works. Where required by law, we present a cookie or consent notice so you can manage your choices.

6. The AirDSP App, Device Data, and Cloud Content

The AirDSP app connects to your Acoustas hardware, typically over your local network or Wi-Fi, to control and tune your system. Configuration and preset data you create are stored on your device and your hardware. We may collect diagnostic and crash information to maintain and improve the app.

If you create an Acoustas account and use our cloud features, we also store content such as your presets, channel names, device and system configurations, saved models, and related metadata in the cloud, so you can back it up and sync it across your devices. You can access, export, or delete this content, or delete your account, using in-app controls where available or by contacting us. We do not use your audio configurations to identify you.

7. Data Retention

We keep personal information for as long as needed to provide the Services, fulfill the purposes described in this Policy, comply with our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. Account and cloud content is retained while your account is active and deleted or anonymized after you delete it or close your account, subject to any legal retention requirements.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Your Privacy Rights

Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, to restrict or object to certain processing, and to withdraw consent. To exercise any of these rights, email info@acoustas.com. We will respond as required by applicable law and will not discriminate against you for exercising your rights.

United States: Residents of certain states (such as California) may have additional rights, including the right to know what personal information we collect and how we use it, and the right to opt out of the sale or sharing of personal information. As noted above, we do not sell your personal information.

EEA and United Kingdom: If you are located in the European Economic Area or the United Kingdom, we process your personal information under a lawful basis such as performance of a contract, our legitimate interests, your consent, or compliance with a legal obligation. You also have the right to lodge a complaint with your local data protection authority.

10. International Data Transfers

We are based in the United States, and your information may be processed in the United States and other countries where we or our service providers operate. Where required, we take steps to ensure your information receives an adequate level of protection when transferred internationally.

11. Children's Privacy

The Site and Services are not directed to children under 13 (or the minimum age required in your jurisdiction), and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will delete it.

12. Third-Party Links

The Site may link to third-party websites and services we do not control. This Policy does not apply to those sites, and we encourage you to review their privacy policies.

We may update this Policy from time to time. When we do, we will revise the Last Updated date above and, where appropriate, provide additional notice. Your continued use of the Site or Services after changes become effective constitutes acceptance of the updated Policy.
